Terms and Conditions

Jelly provides hosting services to clients all over Australia. We have the responsibility to protect each client and provide them with the best services available. The following Terms and Conditions were designed to ensure these services.

All services provided by Jelly may be used for lawful purposes only. Transmission, storage, or presentation of any information, data or material in violation of any Australian Federal, State or City Council law is prohibited. This includes, but is not limited to: copyrighted material, material we judge to be threatening or obscene, unlicensed software or files, or material protected by trade secret and other statute. The subscriber agrees to indemnify and hold harmless Jelly from any claims resulting from the use of the service which damages the subscriber or any other party.

Examples of non-acceptable content or links:

  • Pirated software
  • Copyrighted material
  • Illegal MP3s
  • Hackers programs or archives
  • Warez sites
  • Hate sites
  • Child pornography
  • Adult pornography

Jelly will be the sole arbiter as to what constitutes a violation of this provision.

Unlimited Traffic/Hits & Server Resource Usage:
Jelly is pleased to offer our clients unlimited traffic/hits and server usage. Unlimited traffic/hits refers to the number of visitors to your website, NOT the amount of bandwidth/data transfer. Your account is still limited to the allotted bandwidth/data transfer included with your selected package. To maintain the integrity of our service the following traffic/usage limitations apply:

  • Sites with banners, graphics or CGIs running from their domain being used on other domains.
  • Sites with immense graphic archives or galleries.
  • Sites offering immense download archives, such as .zip, .tar, .ra and .gz.
  • Sites running large chat room gatherings.
  • Sites using more than 20% of system resources.

Jelly will be the sole arbiter as to what constitutes a violation of usage limitations. Bandwidth/data transfer will go unmonitored until you reach your account limit, then normal over-usage data transfer costs will apply. At any time Jelly may move your site to a different server, to reduce the load on the server you are currently residing.

Cron Jobs:
Jelly does allow Cron Jobs to be conducted on our servers.

Jelly currently does not allow IRC or IRC bots to be operated on our servers.

Multiple Connections:
Multiple FTP sessions are allowed on a single hosting account.

Commercial Advertising - Email:
Spamming, or the sending of unsolicited email from a Jelly server or using an email address that is maintained on a Jelly machine is STRICTLY prohibited.
Jelly will be the sole arbiter as to what constitutes a violation of this provision.

Server Abuse:
Any attempts to undermine or cause harm to a Jelly server or customer of Jelly is strictly prohibited. Jelly will pursue legal action to the fullest extent for all abuse of the Jelly Network.

If any terms or conditions are not followed, it will result in grounds for account suspension or de-activation. Jelly reserves the right to remove any account without prior notice. If Jelly deactivates your account(s) for violating policy, you will forfeit your rights to a refund... and none will be given. No refunds for advance payments on de-activated accounts. Normal policy is a warning first, and account de-activation the second offence. Serious offences may cause immediate de-activation.

A $50 fee is payable to activate any suspended accounts. This includes suspended accounts from non payment of invoices.

Privacy Policy:
Jelly respects the privacy of every individual who visits our web sites, responds to our advertisements or sends us e-mail. We will not give or sell your information to any third party or mailing list. All information collected will remain private and confidential. We may contact you from time to time concerning your account, policy changes and special offers.

Indemnification Policy:
You agree to use all Jelly services and facilities at your own risk. Jelly specifically disclaims all warranties of merchantability and fitness for a particular purpose. In no event shall Jelly be liable for any loss, or loss of data, or other commercial damage, including but not limited to special, incidental, consequential or other damages. Customer agrees that it shall defend, indemnify, save and hold Jelly harmless from any and all demands, liabilities, losses, costs and claims, including reasonable attorney’s fees asserted against Jelly, its agents, its customers, officers and employees, that may arise or result from any service provided or performed or agreed to be performed or any product sold by customers, their agents, employees or assigns.

Customers agree to defend, indemnify and hold harmless Jelly against liabilities arising out of:

  • Any injury to person or property caused by any products sold or otherwise distributed in connection with a Jelly server.
  • Any material supplied by customers infringing or allegedly infringing on the proprietary rights of a third party.
  • Copyright infringement.
  • Any defective products sold to customers from a Jelly server.

Jelly shall be the sole arbiter of what violates this policy.

Our Services:
We will host your site on whatever plan you choose. The monthly or yearly plan price is for hosting only, it's up to you to build and maintain your site. We offer website design, updates and maintenance at an additional cost click here. All sites are different, some never need to be updated, some are updated hourly. This is an another consideration often overlooked in having a site online. Support questions regarding hosting are free of charge. We don't offer PC support for items unrelated to hosting or support for your ISP connection to the internet.

Data Backups:
Always keep a local copy of all your data. Our servers do regular backups but Jelly will not be liable for any data loss.

Account Cancellations:
Simply send an email to This email address is being protected from spambots. You need JavaScript enabled to view it. and include your domain name and a contact person.
We'll then cancel your account at the end of the next billing period. There's no partial refund of your 3, 6 or 12 months hosting in advance. We'll continue to host your site until then although you're free to change your 'nameservers' and move your site before that. Email us at least 3 or 4 days before your next billing period.

Jelly reserves the right to change or modify these Terms and Conditions and will post changes to our website at time of modification.
